*‘JUSTICE KARNAN’S CASE’*
*Request to all Advocates & Citizens*
That Justice Karnan had filed an Appeal cum Writ against the order passed by the 7 Judge Bench. As per Sec.19 of the contempt of courts Act, 1971 the appeal is to be heard by a larger Bench of 9 or 11 Judges.
But Chief Justice of India, Shri. J. S. khehar is not going to form the Bench. Needless to mention that for terrorists like Yakub Menon, Supreme Court heard the matter by forming special bench at 3 A.M.
Bail was granted to Salman Khan on the same day. But for a person who is a Judge of High Court, no Bench is formed even after repeated mentioning by Adv. Matthew Nedumpara. On the contrary Advocate who care, also the officer of the Court are being insulted by C.J.I.
As per Full Bench Judgment in Hari Nath Sharma’s Case (1995)4 SCC 25, Supreme Court had made a legal position clear that while passing a sentence under the Contempt of Court Act, the Court is bound to suspend the sentence for giving appropriate time to the alleged contemnor to appraoch the appellate Court. But the said law is not followed by the 7 Judge least to say they acted and acting in utter disregard and defiance of Supreme Court's judgments and directions for the reason best known to them.
Now Advocate Matthew Nedumpara is going to approach Hon’ble President of India, under Art.72 of the Constitution of India for suspension of sentence of Justice Karnan. A copy of application is given below.
Those who feel that really injustice is being done to Justice karnan they can send a letter to Hon’ble President of India for stay/ remiting the sentence of Justice karnan.
